Introduction

CoraBay ("we," "us," or "our") provides a platform offering interactive digital services designed to be helpful, supportive, and accessible to individuals and families of different ages and needs ("Service"). Certain features of the Service are designed specifically for use by children, while other features are intended for general audiences.

This Terms of Use Policy explains the rules and guidelines that govern access to and use of the Service. By using CoraBay, you agree to be bound by these terms. If you do not agree, please do not use the Service.

When a feature of the Service is designed for or made available to children under the age of 13 ("Child-Directed Features"), use of those features must be authorized and supervised by a Primary Account Holder (a parent, caregiver, or legal guardian).

Description of Service

CoraBay provides an AI-enabled communication platform where children interact with Silitronian pen-pals to develop conversation skills in a safe, encouraging environment. The Service uses third-party artificial intelligence technologies to generate responses and facilitate conversations.

Verification and Use of Child's Age Information (COPPA)

In order to comply with the Children's Online Privacy Protection Act ("COPPA"), CoraBay may collect a child's date of birth solely for the purposes of verifying the child's age and determining whether parent or guardian consent is required. When applicable, age information may also be used to assist the Primary Account Holder in configuring age-appropriate moderation controls and safety settings for Child-Directed Features of the Service.

Any age-based recommendations are provided to the Primary Account Holder only and are intended as guidance. The Primary Account Holder retains full discretion over whether to accept, modify, or decline these recommendations. A child's age or date of birth is not used for advertising, behavioral profiling, persuasive messaging, or automated decision-making directed at the child.

Optional Service Communications (COPPA)

With the explicit opt-in of the Primary Account Holder, CoraBay may send optional, non-commercial service communications to child users, such as digital postcards, birthday greetings, or seasonal or holiday messages.

These communications are intended to provide a positive, supportive experience and are considered part of the operation of Child-Directed Features of the Service. When applicable, a child's date of birth may be used solely to determine the timing of such messages.

Optional service communications are not advertisements, do not promote third-party products or services, and are not used for behavioral profiling or persuasive messaging. The Primary Account Holder may enable, customize, or disable these communications at any time.

Eligibility and Accounts

To use CoraBay, you must create an account as the Primary Account Holder ("Primary Account Holder"). The Primary Account Holder must be a parent, legal guardian, or caregiver of any child who will use Child-Directed Features of the Service.

By creating an account as the Primary Account Holder, you represent and warrant that:

• • You are at least 18 years of age
• • You are the parent, legal guardian, or caregiver authorized to provide consent for any child who will use Child-Directed Features under your account
• • You consent to the use of Child-Directed Features by children using the Service in accordance with this Terms of Use Policy
• • All information you provide is accurate and complete

As the Primary Account Holder, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, including use of Child-Directed Features by children using the Service.

User Responsibilities

Primary Account Holders are responsible for supervising the use of CoraBay by children using the Service and ensuring compliance with this Terms of Use Policy. You agree to:

• • Monitor children's interactions as appropriate for their age and needs
• • Review conversation history and adjust settings as needed
• • Report any concerns about content or functionality to us promptly
• • Ensure the Service is used in accordance with this Terms of Use Policy

Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or other users. Prohibited activities include:

• • Attempting to circumvent safety features or content moderation
• • Using the Service to harass, abuse, or harm others
• • Interfering with or disrupting the Service or its infrastructure
• • Attempting to access accounts or data belonging to others
• • Using automated systems to access the Service without permission

Intellectual Property

All content within CoraBay, including but not limited to text, graphics, logos, character designs, and software, is owned by or licensed to CoraBay and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written permission.

Third-Party Services

CoraBay uses third-party artificial intelligence services to power pen-pal conversations. While we implement safety measures and content moderation, we cannot guarantee that all AI-generated content will be appropriate for all users. Primary Account Holders should review conversations and adjust moderation settings as appropriate for the children using the Service.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

CoraBay is designed to support communication skill development but is not a substitute for professional therapy, medical advice, or educational services. If a child using the Service has specific communication or developmental needs, please consult with qualified professionals.

Limitation of Liability

To the fullest extent permitted by law, CoraBay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claims arising from this Terms of Use Policy or your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. This ability to suspend or terminate accounts is necessary to protect the Service and our community from potentially malicious activity, abuse, or violations of this Terms of Use Policy.

You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

Subscription and Billing

The Primary Account Holder is responsible for managing payment information and subscription plan selection for their account. Primary Account Holders may cancel their subscription at any time through their account settings. Upon cancellation, you will retain access to the Service for the remainder of your paid subscription. No refunds will be provided for any unused portion of a subscription, but you will not be charged for subsequent billing periods after cancellation. Once your paid subscription expires, access to the Service will be discontinued.

Changes to Terms

We may update this Terms of Use Policy from time to time. We will notify you of any material changes by posting the updated Terms of Use Policy on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms of Use Policy.

Governing Law

This Terms of Use Policy shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
